Disputes

Any dispute relating in any way to your visit to Chitkari or to products you purchase through Chitkari shall be submitted to confidential arbitration in Indore, India, except that, to the extent you have in any manner violated or threatened to violate Chitkari’s intellectual property rights, Chitkari may seek injunctive or other appropriate relief in any court in India or internationally, and you consent to exclusive jurisdiction and venue in such courts.

The disputes shall primarily be resolved through mediation provided under the section 12A of commercial courts act, 2015. A mediator shall be decided upon mutually for purposes of mediation, and in such case where issues are not resolved through mediation, the parties shall agree upon arbitration under this agreement and shall be conducted under the rules then prevailing under the Indian Arbitration and conciliation Act, 1996. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
